What is a private-works CCTP?

The CCTP (Cahier des Clauses Techniques Particulières) is the contractual document precisely describing expected works on a private construction site: technical specifications, mandated materials, applicable standards, execution deadlines, acceptance conditions. It is governed by art. 1779 of the French Civil Code (works contract). The AFNOR NF P03-001 standard (CCAG for private works contracts) serves as default reference for clauses not explicitly covered. The CCTP is annexed to the works contract and binds the contractor and all subcontractors. Its breach constitutes a contractual breach giving rise to penalties or termination.

Why sign a private-works CCTP electronically?

Multi-signers (owner + architect + contractors)

The CCTP must be signed by the project owner, architect/engineering office, and each titular contractor (structural work, plumbing, electrical, etc.). Our flow handles sequential signature with individual SMS OTP — multi-lot tracked.

Voluminous technical annexes

A CCTP often integrates plans, diagrams, technical sheets, certifications. Our flow handles annexes up to 100 MB + generates SHA-256 hash per file — enforceable in case of subsequent contestation on the exact signed version.

30-year archive (decennial liability)

Decennial liability (art. 1792 CCiv) runs 10 years from acceptance + 20 years post-decennial warranty. The CCTP must be kept for this ENTIRE duration. Our 10-year archive + automatic renewal covers 30 years — critical evidence for decennial claim response.

Construction-site amendments tracked

A construction site often sees 5 to 20 amendments to the CCTP (material changes, added services). Each amendment follows the same electronic signature flow, and the eIDAS audit trail allows reconstruction of the complete chronology — useful for responding to a court expert in case of dispute.

Sign a CCTP in 4 steps

From drafting the CCTP to decennial archiving, in under 5 minutes.

  1. 1. Prepare the CCTP

Upload your CCTP PDF + annexes (plans, diagrams, technical sheets). Our NF P03-001-compliant template facilitates drafting: lot-by-lot description, mandated materials, applicable standards, deadlines, late penalties.

  2. 2. Add the signers

Project owner (MOA), architect/engineering office (MOE), titular contractors (one per lot: structural, plumbing, electrical, etc.). Personalised secure link + SMS OTP for each signer.

  3. 3. Choose the eIDAS level

Advanced signature (AES) recommended for a CCTP: presumption of reliability (art. 1367 CCiv), SMS OTP — elements required for decennial litigation before the judicial court. QES is used for contracts > €5M or very high-stakes safety sites.

  4. 4. Sign and archive

Owner signs first, then architect, then each titular contractor signs their lot. Finalised CCTP + annexes + proof PDF archived for 10 years (renewable) — covering decennial liability (art. 1792 CCiv) + 20 years post-decennial warranty.

Frequently asked questions

Can a private-works CCTP be signed electronically?
Yes, without restriction. Art. 1366 of the French Civil Code grants electronic writing the same probative force as paper. The AFNOR NF P03-001 standard does not mandate manuscript signature. Case law (Cass. 3e civ. 14 September 2022) validated electronic signature for works contracts.
Difference between CCTG and CCTP?
CCTG = Cahier des Clauses Techniques Générales (general reference, e.g. public-works fascicules). CCTP = Cahier des Clauses Techniques Particulières (specific to a given site, complements or derogates from the CCTG). For private contracts, only the CCTP is mandatory. AFNOR NF P03-001 (CCAG) plays the default-reference role for clauses not explicitly covered.
Which signature level: SES, AES or QES?
Advanced signature (AES) is the recommended standard for a private-works CCTP. It provides presumption of reliability (art. 1367 CCiv) — essential for responding to decennial litigation (10 years after acceptance). QES is used for contracts > €5M or very high-stakes safety sites.
What must the CCTP mandatorily contain?
(1) Precise site designation (address, cadastre, works type); (2) Lot-by-lot: detailed service description, mandated materials, applicable standards, tolerances; (3) Lot-by-lot execution deadlines; (4) Late penalties (amount and trigger); (5) Acceptance modalities (acceptance report, reserve lifting); (6) Payment conditions (advances, situations, 5% retention); (7) Required insurances (works professional liability, decennial warranty, damages insurance).
How long should the CCTP be kept?
30 years minimum, by accumulation: 10 years of decennial liability (art. 1792 CCiv) + 20 years post-decennial warranty (extinctive prescription). In practice, lifelong retention recommended for risk buildings. Our 10-year renewable archive covers decennial + supports late claim responses.
Is an electronically signed CCTP enforceable in case of decennial dispute?
Yes, without restriction. The eIDAS proof PDF (signer identities, qualified timestamp, SHA-256 hash of CCTP + annexes, SMS OTP) constitutes irrefutable evidence of the contractual version, enforceable against the court expert and judicial court. Case law (Cass. 3e civ. 14 September 2022) validated electronic signature for works contracts.
Can the CCTP be modified during construction?
Yes, by amendment signed by all original parties. Each modification (material change, added service, deadline change) must be subject to an amendment — verbal modification is NOT enforceable. Our flow tracks each amendment in the eIDAS audit trail, allowing reconstruction of the complete chronology — useful for judicial expertise.
Is insurance required to sign the CCTP?
The CCTP must indicate insurances required of titular contractors: (1) works professional liability (recommended minimum €1M); (2) decennial warranty (mandatory for works subject to art. 1792 CCiv); (3) damages insurance (owner's responsibility, guarantees pre-financing of decennial repairs). The insurance certificate is annexed to the CCTP — our flow can integrate insurer signature.
