Yes, in the vast majority of countries. Electronic signature laws almost everywhere rest on the same principle, drawn from the UN's model laws (UNCITRAL): a signature cannot be denied effect merely because it is electronic. In the European Union, the eIDAS regulation (No. 910/2014) makes it enforceable in every Member State; in the United States, it is the ESIGN Act and UETA. Certyneo offers the three levels provided for by eIDAS (simple, advanced and qualified), with time-stamped cryptographic proof attached to every signed document.
No single text makes a signature recognized in every country: each country applies its own law. What matters before a judge is the evidence file — identified signer, sealed document, timestamp, audit trail, archiving — and Certyneo attaches one to every signed document. This file meets the laws that accept any reliable electronic signature (United States, United Kingdom, Canada, Australia) as well as eIDAS requirements. Two limits to know: the eIDAS qualified signature only holds "qualified" status within the European Union, and some countries, including India and Brazil, reserve an enhanced legal presumption for certificates issued by their own national authorities. Finally, certain acts — wills, notarized deeds, real-estate sales — remain excluded from electronic signature in many countries.
Simple electronic signature (SES) authenticates a signer by email and is sufficient for most commercial contracts. Advanced signature (AES) adds an SMS OTP and a certificate linked to the signer, recommended for HR, credit and sensitive contracts. Qualified signature (QES) requires face-to-face or video identity verification and offers the highest probative value provided by eIDAS.
eIDAS (electronic IDentification, Authentication and trust Services) is European regulation No. 910/2014 governing electronic identity and trust services in the European Union since 2016. It defines the legal value of electronic signature, technical requirements for trust service providers and levels of assurance applicable to signatures.
