What is a French rental management mandate?

A French rental management mandate is a contract by which a landlord entrusts a real-estate professional (agency, property manager) with the day-to-day management of one or more rental properties: tenant search, rent collection, repairs management, tax filings, litigation. It is governed by Act no. 70-9 of 2 January 1970 ("Hoguet Act") and subject to strict rules: G professional card (property management), financial guarantee, mandatory clauses, maximum duration and termination conditions.

Frequently asked questions

Can a French rental management mandate be signed electronically?
Yes, without restriction. The Hoguet Act does not require a handwritten signature: only the mentions of article 1 of the decree of 20 July 1972 are mandatory (professional card, financial guarantee, duration, scope, commission). Article 1366 of the Civil Code gives an electronic signature the same value as a paper signature once signer identification and document integrity are guaranteed.
Which signature level: SES, AES or QES?
For a rental management mandate, advanced electronic signature (AES) is the professional standard. It brings a reinforced reliability presumption thanks to identity verification (SMS OTP) and a unique certificate per signer. QES is reserved for real-estate sales by notarial deed; SES (simple signature) is sufficient for minor amendments but underdimensioned for the mandate itself.
What if the property is jointly owned or in community?

What are the mandatory clauses of a management mandate?

Is the rental management mandate different from a sales mandate?
Yes — the management mandate (G card) covers day-to-day management of a leased property (rents, repairs, tax). The sales mandate (T card) covers the search for a buyer. The legal obligations, commissions and maximum duration are distinct; a real-estate agent must hold the right professional card for each activity.
Can an electronically-signed management mandate be terminated?
Yes — termination follows the same rules as for a paper mandate: respect of the notice period set in the contract (typically 1 to 3 months), notification by registered letter or any means provided in the mandate. The termination itself can be signed electronically and archived with the original mandate.
Is the electronically-signed mandate enforceable in court?
Yes — French case law unanimously recognises eIDAS-compliant electronic signatures. The reliability presumption of article 1367 of the Civil Code makes an advanced electronic signature (AES) enforceable without further proof, provided the eIDAS audit trail is produced in court (evidence PDF delivered automatically by Certyneo).
