What is a CSE mandate?

The CSE mandate is the act by which an elected member of the Social and Economic Committee confers to another member (or to a union delegate) the power to represent them in a specific body: health-safety committee (CSSCT), training committee, collective bargaining, disciplinary council, etc. Following the 22 September 2017 reform that merged employee representative bodies into the CSE, the mandate is governed by art. L2314-1 et seq. of the French Labour Code. Without a signed written mandate, the mandatary cannot represent the mandator — any decision taken would be void.

Why sign a CSE mandate electronically?

Multi-signers (mandator + mandatary)

The mandate binds two CSE elected members: the mandator (conferring the power) and the mandatary (receiving it). Our flow handles sequential signature with individual SMS OTP identity verification. Complete audit trail of both-party agreement.

Archive aligned with mandate term

A CSE mandate has a maximum duration of 4 years (unless a collective agreement provides for 2 or 3 years). Our 10-year archive covers the ENTIRE term + 6 years for post-mandate disputes. Aligned with French common-law statute of limitations (art. 2224 CCiv).

Multiple simultaneous mandates without confusion

A CSE elected member can hold several mandates simultaneously (health-safety committee + training committee + alternate). Our dashboard displays all active mandates per elected member — useful for the CSE secretary managing the committee agenda.

Enforceability against employer tracked

The mandate must be notified to the employer to produce effects (notably for delegation hours). Our flow generates automatic notification to the employer with eIDAS audit trail — enforceable mandate effective date.

Sign a CSE mandate in 4 steps

From drafting the mandate to employer notification, in under 5 minutes.

  1. 1. Prepare the mandate

Upload your PDF or use our L2314-1-compliant template: identity of mandator and mandatary (name, role, optional union affiliation), specific subject of the mandate (CSSCT, agreement X negotiation, disciplinary council), duration, revocation conditions.

  2. 2. Add the signers

Mandator (CSE elected member or alternate) + mandatary (another CSE elected member or union delegate). Each receives a personalised secure link by email with SMS OTP identity verification.

  3. 3. Choose the eIDAS level

Advanced signature (AES) recommended for a CSE mandate: presumption of reliability (art. 1367 CCiv), SMS OTP — elements required for contestation before the French judicial court (which replaced the TGI in 2020 for CSE electoral disputes).

  4. 4. Sign, notify, archive

Mandator signs, then mandatary. Automatic notification to the employer + CSE secretary. Mandate archived for 10 years with its audit trail — accessible anytime to respond to electoral disputes or labour-inspection audit.

Frequently asked questions

Can a CSE mandate be signed electronically?
Yes, without restriction. Art. 1366 of the French Civil Code grants electronic writing the same probative force as paper. The Labour Code (art. L2314-1) does not mandate manuscript signature. CSE practice since 2018 has validated electronic signature for internal mandates.
What are the most common types of CSE mandates?
(1) Health-Safety and Working Conditions Committee (CSSCT) mandate (mandatory from 300 employees); (2) Training committee mandate; (3) Collective bargaining mandate; (4) Disciplinary council representation; (5) Hygiene committee representation. Each can have a different duration (often 1 year renewable).
Which signature level: SES, AES or QES?
Advanced signature (AES) is the recommended standard for a CSE mandate. It provides presumption of reliability (art. 1367 CCiv) — essential for contestation before the judicial court (union-designation disputes). SES is undersized. QES is used for very high-stakes collective bargaining (redundancy plans).
Must the mandate be notified to the employer?
Yes, for mandates with external effects (delegation hours, access to confidential information). Notification is by registered mail or electronic signature with delivery receipt (our flow generates it automatically). For purely internal CSE mandates (training committee, agenda), notification is not mandatory.
What is the maximum duration of a CSE mandate?
4 years, i.e. the maximum duration of a CSE term (art. L2314-34 French Labour Code). A company or group agreement can reduce this to 2 or 3 years. A mandate can be conferred for the entire term or a shorter period (committee duration, negotiation duration).
Can a CSE mandate be revoked before its term?
Yes — the mandator can revoke their mandate at any time by signed letter. Revocation must be notified to the mandatary + employer + CSE secretary. Our flow manages the revocation workflow with eIDAS audit trail — enforceable effective date.
How long should a CSE mandate be kept?
For the entire term (4 years max) + 6 years after expiry (5-year limitation + 1-year buffer). In practice, 10 years recommended to cover late electoral disputes. Certyneo automatically archives 10 years, free of charge.
Is an electronically signed CSE mandate enforceable in electoral dispute?
Yes, without restriction. The eIDAS proof PDF (signer identities, qualified timestamp, SMS OTP) constitutes irrefutable evidence, enforceable before the judicial court (competent for CSE electoral disputes since 2020 reform). Case law since 2019 has validated advanced electronic signature for intra-CSE acts.
