Le commissaire de justice intervient dans deux registres distincts. Les ACTES MINISTÉRIELS relevant de son monopole (significations d'assignations, commandements, sommations, constats, procès-verbaux, ventes judiciaires) sont, lorsqu'ils sont dématérialisés, signifiés par voie électronique au sens des articles 748-1 et suivants du Code de procédure civile, via la plateforme sécurisée SECURACT de la Chambre nationale des commissaires de justice, avec signature électronique qualifiée et dispositif professionnel dédié — un périmètre non couvert par Certyneo. Les ACTES SOUS SEING PRIVÉ de l'étude (mandats de recouvrement amiable de créances régis par le décret n° 96-1112, conventions d'honoraires, contrats de recouvrement conclus avec les créanciers, lettres de mission, engagements de confidentialité, conventions avec les prestataires et partenaires) sont en revanche parfaitement couverts par la signature électronique avancée (AES). Certyneo dématérialise toute cette relation contractuelle de l'étude, avec un niveau de preuve compatible avec les exigences déontologiques de la profession et le secret professionnel.

    Advanced signature (AES) recommended for private deeds of the office: identity verification via SMS OTP, single certificate, qualified timestamp. Compliant with article 26 of the eIDAS regulation and compatible with the professional ethics requirements of the profession.

    The finalized deed and its audit trail are archived with probative value. Exportable at any time for transmission to a successor colleague or production before the regional chamber of bailiffs.

Can Certyneo be used for service of process and statements of fact?
No — service of process and statements of fact fall under the ministerial monopoly of the bailiff. Dematerialized, they use electronic service of process (articles 748-1 et seq. of the Code of Civil Procedure) via the secure SECURACT platform of the National Chamber of Bailiffs, with qualified signature and dedicated professional system. This is not within Certyneo''s scope, which covers the entirety of the contractual relationship UNDER PRIVATE DEED of the office.
Can the amicable collection mandate be signed electronically?
Yes. The amicable collection mandate for claims is a private deed contract, governed by decree no. 96-1112 of 18 December 1996, which imposes certain provisions but no particular form. Certyneo advanced signature + qualified timestamp satisfy its evidential requirements, with the advantage of precisely timestamping the mandate date before collection actions begin.
How to respect the professional privilege of the bailiff?

Private deed documents related to the practice''s activity must be retained for a minimum of 10 years (standard prescription period, art. 2224 French Civil Code). For recovery files with long execution timelines, extended retention is recommended. Certyneo archives for 10 years inclusive, with extension available.
Is the electronic private deed enforceable?
Yes — French case law unanimously recognizes eIDAS-compliant electronic signatures. The reliability presumption of art. 1367 French Civil Code makes the advanced signature (AES) enforceable without further demonstration, including for recovery mandates and agreements executed by the practice.
