Do I need an EIN for an LLC?

It depends on how your LLC is set up and what it does. Here's when an EIN is required, when it's optional, and why it's usually worth getting anyway.

The short answer

Many LLCs are required to have an EIN, and even those that aren't usually benefit from one. The requirement turns on whether your LLC has more than one member, hires employees, or elects corporate taxation — but banking and privacy reasons often make an EIN the right call regardless.

Single-member LLCs

A single-member LLC with no employees is treated as a “disregarded entity” for taxes and can sometimes use the owner's Social Security Number. However, most banks require an EIN to open a business account, and using an EIN keeps your SSN off W-9s and contracts — reducing identity-theft exposure.

Multi-member LLCs

A multi-member LLC must have an EIN. It's taxed as a partnership by default and files its own returns, which requires a federal tax ID. If your LLC has more than one owner, getting an EIN isn't optional.

When an EIN is always required

Regardless of member count, your LLC needs an EIN if it hires employees, elects to be taxed as a corporation (S-corp or C-corp), files certain excise or employment tax returns, or is required to withhold taxes on income paid to a non-resident. When in doubt, get one — it's free and takes minutes.
