What's a construction site receipt PV?

The receipt of the works (Art. 1792-6 Civil Code) is the legal act by which the contractor declares to accept the work with or without reservations. This is a critical legal point: it marks the transfer of the custody of the work from the contractor to the contractor, and runs the time limits of THREE legal guarantees: (1) guarantee of perfect completion (1 year, Art. 1792-6 al. 2) covering ALL the disorders reserved for the reception or appeared in the year, (2) two-year guarantee of proper maintenance (2 years, Art. 1792-3) on the elements of equipment that can be disassembled, (3) ten-year guarantee (10 years, 1792) on the guarantees of the indestructibility of the work or the critical functioning of the domain.

Frequently Asked Questions

Can a site receipt be signed electronically?
Yes, without restriction. Article 1792-6 of the Civil Code requires a written document but does not prescribe any particular form. Article 1366 of the Civil Code recognizes the same evidentiary force as electronic documents. The advanced signature Certyneo satisfies the evidentiary requirements.
Can the reception be quiet ?
The case law (Cass. civ. 3e) allows for tacit acceptance when the contractor takes possession of the work AND pays the market balance, thus demonstrating an unequivocal willingness to accept the work.
What if we have reservations at the reception ?
The PV lists the reserves with precision (nature of the defect, location, deadline for withdrawal).The contractor has 1 year to withdraw the reserves as part of the guarantee of perfect completion (Art. 1792-6 para. 2).The withdrawal of reserves is itself formalized by a signed PV ( PV of withdrawal of reserves ) Certyneo allows it to be signed as the original PV.
What's the starting point for the 10-year guarantee?
The date of receipt (Art. 1792). If the receipt took place on 15 March 2026, the decennial runs until 15 March 2036 inclusive. Critical: without a signed PV, the date of receipt is questionable and can be advanced by the contractor (favouring the expiry of the guarantees).
What signature level for a receiving PV?
The EIA is not sufficient for this type of act, but it is a legal document which is not subject to any legal obligation to provide a guarantee for the protection of the rights of the parties.
How long do you need to keep the PV?

Can the reception be given by only one of the co-owners (co-ownership, division)?
No the receipt commits the entire co-ownership or the indivision. For a co-ownership, the trustee or the delegated contractor signs on behalf of the union. For an indivision, all co-individual (or a common agent) sign. Certyneo manages this multi-signature configuration.
Is the electronically signed CV admissible in a judicial expert's hearing?
