The value of evidence in the social context

Act No. 2000-321 — subsidies and agreements

Article 9-1, inserted by Act No. 2014-856 of 31 July 2014, defines the subsidy; article 10 requires an agreement above €23,000 a year, the framework for the multi-year objective agreement (CPO) between an association and a local authority. Frequently Asked Questions

Can the articles of association be signed electronically?

The law of 1 July 1901 does not require the handwritten signature of the statutes. Article 1366 of the Civil Code recognizes the electronic writing as having the same evidentiary force as the paper writing. The advanced signature (AES) Certyneo is accepted by the prefectures via the e-creation service-public.fr teleservice.

Does the prefecture accept an electronically signed statement?

Yes the e-creation teleservice (service-public.fr/associations) accepts the upload of documents signed electronically. For associations that prefer paper format, the signature can also be printed and sent by post (the prefectures continue to accept both formats).

Can an AG of an association keep a distance?

Yes, if the statutes or the internal rules of the association provide for it: the law of 1901 leaves it to the statutes to organise remote or hybrid AGs (videoconference, voting by correspondence or electronically). The derogatory regime of Order No. 2020-321, tied to Covid, ended in 2022.

What level of signature for the statutes?

The SES is not sufficient for associations with financial problems (grants > €23k).

Can a multiannual objectives agreement (MPA) with a community be signed electronically?

Yes. Act No. 2000-321 does not require a handwritten signature. Larger local authorities (regions, metropolitan areas) increasingly accept advanced signatures to reduce delays. Check with your partner local authority to confirm its specific acceptance.

How long do we keep the charter and the P.V. ?

For associations receiving public subsidies, proof of use of funds is kept for 10 years (Art. L1611-4 CGCT).

Can the Auditor sign the annual accounts electronically?

Yes — Article L823-12-1 of the Commercial Code permits electronic signature of auditor certifications and reports. For associations with >€153k in grants, this has been standard practice since 2024.
