What is a property management mandate?
A property management mandate is a contract by which a property owner entrusts a real estate professional (agency, property manager) with the day-to-day management of one or more rental properties: tenant search, rent collection, maintenance management, tax reporting, dispute resolution. It is governed by Law No. 70-9 of January 2, 1970 (known as the "Hoguet law") and subject to strict rules: professional card G (property management), financial guarantee, mandatory provisions, maximum duration and termination conditions.
Why sign the mandate electronically?
Identical legal force
Article 1366 of the Civil Code recognizes electronic documents the same probative force as paper documents, provided that the person from whom it comes can be identified and the document is kept under conditions guaranteeing its integrity. No Hoguet decision requires a handwritten signature.
Multi-signatories (couple, co-ownership)
When the property is held in co-ownership or joint ownership, all co-owners must sign under penalty of partial nullity. Our workflow handles sequential or parallel signing: each signatory receives an individual secure link protected by SMS OTP and signs at their own pace.
10-year archival included
Article 72 of the Decree of July 20, 1972 requires the real estate agent to retain mandates for 10 years. Certyneo automatically archives the signed mandate + its eIDAS audit trail for the entire duration, accessible in one click from your dashboard.
Enforceable eIDAS audit trail
Each mandate comes with a proof PDF: identity of signatories, qualified timestamp, SHA-256 hash, IP geolocation, SMS OTP verification. Enforceable in case of dispute over the commission, duration or powers granted.

Upload your existing PDF or start from a legally compliant Hoguet template (professional card, financial guarantee, duration, commissions, limited enumerated powers).
2. Add signatories
Real estate agent + owner(s). In co-ownership or joint property, add all co-owners. Each receives a personalized secure link by email.

4. Sign and archive
Each signatory signs from their phone or computer. The finalized mandate + proof PDF are automatically archived for 10 years, accessible at any time.
Frequently asked questions
- Can a rental management mandate be signed electronically?
- Yes, without restriction. The Hoguet law does not require handwritten signature: only the provisions of article 1 of the decree of 20 July 1972 are mandatory (professional card, financial guarantee, duration, scope, commission). Article 1366 of the Civil Code confers the same legal force on electronic signature as on paper signature as soon as the signatory's identification and the document's integrity are guaranteed.
- Which signature level to choose: SES, AES or QES?
- For a rental management mandate, advanced signature (AES) is the professional standard. It provides enhanced reliability through identity verification (OTP SMS) and a unique certificate per signatory. QES is reserved for real estate sales by authentic deed (notary); SES (simple signature) is sufficient for minor amendments but undersized for the mandate itself.
- What to do in case of co-ownership or undivided ownership?
- All co-owners must sign the mandate under penalty of partial nullity (art. 815-3 Civil Code). Certyneo's multi-signatory flow handles sequential (one after another) or parallel (all at once) signing. Each signatory receives their personal link with OTP SMS on their own number — no credential sharing.
- How long must the mandate be retained?
- 10 years from the end of the mandate, in accordance with article 72 of decree no. 72-678 of 20 July 1972. Certyneo retains the signed mandate and its eIDAS audit trail for this entire period, free of charge, with immediate access from your dashboard to respond to a CCI or DGCCRF audit.
- What are the mandatory provisions of a management mandate?
- Full identity of the parties, professional card number G of the agent, organization and amount of financial guarantee, duration (maximum 30 years in management), powers limited and specifically enumerated, remuneration terms (commission rate or amount), termination and notice conditions, designation of competent jurisdiction.
- Is the rental management mandate different from the sale mandate?
- Yes — the management mandate (card G) concerns the routine management of a leased property (rents, repairs, tax). The sale mandate (card T) concerns finding a buyer. The legal obligations, commissions and maximum duration are distinct; a real estate agent must hold the correct professional card to exercise each activity.
- Can an electronically signed management mandate be terminated?
- Yes — termination follows the same rules as a paper mandate: respect for the notice period set in the contract (generally 1 to 3 months), notification by registered letter or any means provided for in the mandate. The termination itself can be electronically signed and archived with the initial mandate.
- Is the electronically signed mandate enforceable before the courts?
- Yes — French case law unanimously recognizes eIDAS-compliant electronic signature. The reliability presumption of article 1367 of the Civil Code makes advanced signature (AES) enforceable without further demonstration, provided the eIDAS audit trail is produced in court (proof PDF automatically delivered by Certyneo).
