What is a property management mandate?

A property management mandate is a contract by which a property owner entrusts a real estate professional (agency, property manager) with the day-to-day management of one or more rental properties: tenant search, rent collection, maintenance management, tax reporting, dispute resolution. It is governed by Law No. 70-9 of January 2, 1970 (known as the "Hoguet law") and subject to strict rules: professional card G (property management), financial guarantee, mandatory provisions, maximum duration and termination conditions.

Frequently asked questions

Can a rental management mandate be signed electronically?
Yes, without restriction. The Hoguet law does not require handwritten signature: only the provisions of article 1 of the decree of 20 July 1972 are mandatory (professional card, financial guarantee, duration, scope, commission). Article 1366 of the Civil Code confers the same legal force on electronic signature as on paper signature as soon as the signatory's identification and the document's integrity are guaranteed.
Which signature level to choose: SES, AES or QES?
For a rental management mandate, advanced signature (AES) is the professional standard. It provides enhanced reliability through identity verification (OTP SMS) and a unique certificate per signatory. QES is reserved for real estate sales by authentic deed (notary); SES (simple signature) is sufficient for minor amendments but undersized for the mandate itself.
What to do in case of co-ownership or undivided ownership?

How long must the mandate be retained?

What are the mandatory provisions of a management mandate?
Full identity of the parties, professional card number G of the agent, organization and amount of financial guarantee, duration (maximum 30 years in management), powers limited and specifically enumerated, remuneration terms (commission rate or amount), termination and notice conditions, designation of competent jurisdiction.
Is the rental management mandate different from the sale mandate?
Yes — the management mandate (card G) concerns the routine management of a leased property (rents, repairs, tax). The sale mandate (card T) concerns finding a buyer. The legal obligations, commissions and maximum duration are distinct; a real estate agent must hold the correct professional card to exercise each activity.
Can an electronically signed management mandate be terminated?
Yes — termination follows the same rules as a paper mandate: respect for the notice period set in the contract (generally 1 to 3 months), notification by registered letter or any means provided for in the mandate. The termination itself can be electronically signed and archived with the initial mandate.
Is the electronically signed mandate enforceable before the courts?
Yes — French case law unanimously recognizes eIDAS-compliant electronic signature. The reliability presumption of article 1367 of the Civil Code makes advanced signature (AES) enforceable without further demonstration, provided the eIDAS audit trail is produced in court (proof PDF automatically delivered by Certyneo).
