What is a partnership agreement?
A partnership agreement formalizes a collaboration between an association and an external partner (public authority, foundation, patronage company). When it involves the payment of a multiannual public grant, it is a multiannual agreement of objectives (CPO) governed by Article 9-1 of Law 2014-856 of 31 July 1985. It must define precisely the objectives assigned to the association, the means granted, the evaluation indicators and the control modalities.

Frequently Asked Questions
- Can a partnership agreement be signed electronically?
- Yes, without restriction. Law 2014-856 does not require the handwritten signature. Article 1366 of the Civil Code recognizes the same evidentiary force in electronic writing. The advanced signature Certyneo meets the evidentiary requirements.
- Do public authorities accept electronic signatures?
- Yes, more and more. Large municipalities (regions, metropolises, departments) accept the advanced signature (AES) to reduce time. Small municipalities can still prefer the paper format ask your partner municipality.
- How can the obligations to monitor the use of subsidies be met?
- Article L1611-4 of the CGCT requires the association to produce the employment report of the grant within 6 months of the end of the financial year.

- Does a patronage agreement give you a right to a tax reduction?
- Yes for the patron company (Art. 238a CGI: 60 per cent of the donation up to 0.5 per cent of the CA) or individual (Art. 200 CGI: 66 per cent of the donation up to 20 per cent of the taxable income).
- How long does a convention have to last ?
- For conventions involving European funding (ESF, ERDF), retention up to 10 years after the closure of the programme.
- Can we change an agreement by signing it electronically?
- Yes the endorsements (amendment of subject matter, grounds, extension) are signed as the original agreement, with advanced signature + qualified time stamp.
- Is the electronically signed agreement enforceable before the court?
- The presumption of reliability of Article 1367 of the Civil Code makes the advanced signature (AES) open to challenge, including before the regional Chamber of Accounts in the event of a subsidy use control.
