Statutes, general meeting minutes, partnership agreements, declarations to the prefecture, proxies: dematerialise all documents signed by your association with an eIDAS proof level. Article 9-1, inserted by Act No. 2014-856 of 31 July 2014, defines the subsidy; article 10 requires an agreement above €23,000 a year, the framework for the multi-year objective agreement (CPO) between an association and a local authority. Yes the e-creation teleservice (service-public.fr/associations) accepts the upload of documents signed electronically. For associations that prefer paper format, the signature can also be printed and sent by post (the prefectures continue to accept both formats).
Yes, if the association's statutes or internal rules provide for it: the 1901 law leaves it to the statutes to organise remote or hybrid general meetings (videoconference, voting by correspondence or electronically). The derogatory regime of Order No. 2020-321, linked to Covid, ended in 2022. Electronic signature of the minutes by the board (chairman, secretary) is permitted.
Advanced signature (AES) is recommended. It is admissible in court (Article 1367 Civil Code), its evidence file establishes its reliability in case of dispute (the presumption of reliability is reserved for the qualified signature), and it meets prefecture requirements. The SES is not sufficient for associations with significant financial stakes (grants > €23k).
Yes. Act No. 2000-321 does not require a handwritten signature. Larger local authorities (regions, metropolitan areas) increasingly accept advanced signatures to reduce delays. Check with your partner local authority to confirm its specific acceptance.
