What is a borrower insurance delegation?
Borrower insurance delegation allows customers to replace the insurance offered by their credit institution with a contract from another company, subject to equivalent coverage terms. Introduced by the Hamon Law (2014), strengthened by the Bourquin amendment (cancellation at annual renewal) and generalized by the Lemoine Law (cancellation at any time since February 2022), this right is now exercised without special formalities and with advanced electronic signature.

Frequently asked questions
- Who can use borrower''s insurance delegation?
- Any borrower with a mortgage or consumer loan covered by insurance. The Lemoine Act (February 2022) eliminates waiting periods: you can change insurance at any time without fees or penalties, provided equivalent guarantees are accepted by your lender.
- What is guarantee equivalence?
- Your new insurance must cover the same risks and capital levels as the bank contract: death, permanent total disability (PTD), work incapacity (WI), job loss, etc. Your bank has 10 days to validate equivalence. Certyneo facilitates this comparison in your delegation contract.
- Is electronic signature legally recognized?
- Yes. Certyneo''s advanced signature (AES) complies with the eIDAS regulation (No. 910/2014). It produces the same legal effects as a handwritten signature and is accepted by all banks and insurance companies. The audit trail and qualified timestamping provide incontestable proof.
- How long is my document kept?
- Certyneo archives your PDF proof for a minimum of 10 years, hosted in the EU (IONOS Germany). You retain unlimited access from your dashboard. You can download your documents at any time.
- Is a health questionnaire required for delegation?
- No, except in exceptional circumstances. The Lemoine law eliminates the health questionnaire if: the insured amount (death benefits and annuity) is less than €200,000 AND credit repayment ends before the borrower turns 60. Beyond that, your new insurance may request medical information.
- What is the cost of online signing at Certyneo?
- Unlimited free plan: signing, archiving and document access. No hidden fees. Certyneo offers transparent usage-based billing for large-scale needs (volumes > 100 signatures/month).
- When does delegation become effective?
- After advanced signature and validation of guarantee equivalence by your bank (10 days). The Lemoine law guarantees fee-free cancellation of your old contract. Your new insurance takes effect on the date specified in the delegation deed.
- How does Certyneo ensure the confidentiality of my data?
- TLS encryption in transit, EU hosting (IONOS Germany) compliant with GDPR, internal audit trail tracking all access. No data sharing with third parties. Complete confidentiality of your loan and health file.
