Electronic signature solution for court bailiffs' studies (profession born from the merger of bailiffs and bailiffs-receivers, exclusive status as of 1 July 2026) for the management of private-seing documents of the study : warrants for the friendly collection of debts, fee agreements, collective agreements with creditors, letters of mission, confidentiality commitments, agreements with partners. Que peut signer un commissaire de justice avec Certyneo ?

A commissaire de justice (the French judicial officer who replaced the huissier de justice) works in two distinct areas. The OFFICIAL ACTS within their monopoly (service of summonses, formal demands, notices, bailiff's reports, official records, judicial sales) are, when dematerialised, served electronically under articles 748-1 et seq. of the French Code of Civil Procedure, through the SECURACT secure platform of the Chambre nationale des commissaires de justice, with a qualified electronic signature and a dedicated professional device — a scope Certyneo does not cover. The office's PRIVATE DEEDS (amicable debt-collection mandates governed by decree no. 96-1112, fee agreements, collection contracts with creditors, engagement letters, confidentiality undertakings, agreements with suppliers and partners) are, on the other hand, fully covered by the advanced electronic signature (AES). Certyneo dematerialises this entire contractual relationship of the office, with a level of evidence compatible with the profession's ethical requirements and professional secrecy. In practice, “electronic signature for a huissier de justice” now means the same thing: the huissier de justice became a commissaire de justice (ordinance no. 2016-728), and the office's private deeds are signed with an advanced signature (AES) on Certyneo.

Un commissaire de justice peut-il signer ses actes électroniquement ?
Since Ordinance No. 2016-728, the judicial officer has become a judicial commissioner (merger with judicial auctioneers; exclusive status effective July 1, 2026). The term “electronic signature for judicial officers” therefore now refers to the electronic signature of the judicial commissioner. A distinction must be made between two categories: private documents issued by the office (amicable collection mandates, fee agreements, engagement letters, contracts with creditors) can be signed using Certyneo’s advanced electronic signature (AES); official documents (services of process, reports, and minutes), on the other hand, are subject to a separate system of electronic service via the profession’s SECURACT platform.
Can Certyneo be used for meaning and observations?
No the service and statements are the exclusive responsibility of the Commissioner of Justice. They are not digitised and are served electronically (Articles 748-1 et seq. of the Code of Civil Procedure) via the SECURACT secure platform of the National Chamber of Commissioners of Justice, with a qualified signature and a dedicated professional device.
Can the collective bargaining agreement be signed electronically?
Yes. The amicable collection mandate for claims is a private deed contract, governed by decree no. 96-1112 of 18 December 1996, which imposes certain provisions but no particular form. Can I get a bunch of collections orders signed?

How long must the documents be kept in private?
The documents in private storage relating to the study activity must be kept for a minimum of 10 years (common law limitation period, Art. 2224 of the Civil Code).
Is the electronic private document open to challenge?
Yes — French case law recognises eIDAS-compliant electronic signature. The advanced signature (AES) is admissible as evidence (Articles 1366 and 1367 of the Civil Code), including for recovery mandates and agreements concluded by the practice; its reliability is demonstrated by the audit trail, the presumption of reliability being reserved for the qualified signature.
