What is a property management mandate?
A property management mandate is a contract by which a landlord owner entrusts a real estate professional (agency, property administrator) with the day-to-day management of one or more rental properties: tenant search, rent collection, work management, tax reporting, disputes. It is governed by law No. 70-9 of January 2, 1970 (known as the "Hoguet law") and subject to strict rules: professional card G (property management), financial guarantee, mandatory provisions, maximum duration and termination conditions.

- Can a property management mandate be signed electronically?
- Yes, without restriction. Hoguet law does not require a handwritten signature: only the provisions of article 1 of the decree of July 20, 1972 are mandatory (professional card, financial guarantee, duration, purpose, commission). Article 1366 of the Civil Code confers on electronic signatures the same value as paper signatures as soon as the signatory''s identification and document integrity are guaranteed.
- Which signature level to choose: SES, AES or QES?
- For a property management mandate, advanced signature (AES) is the professional standard. It provides enhanced reliability through identity verification (SMS OTP) and a unique certificate per signatory. QES is reserved for real estate sales by public deed (notary); SES (simple signature) is sufficient for minor amendments but undersized for the mandate itself.
- What to do in case of co-ownership or co-tenancy?

- Yes — the management mandate (card G) concerns day-to-day management of a rented property (rents, works, taxation). The sales mandate (card T) concerns finding a buyer. Legal obligations, commissions and maximum duration are distinct; a real estate agent must hold the correct professional card to exercise each activity.
- Can a property management mandate signed electronically be terminated?
- Yes — termination follows the same rules as for a paper mandate: compliance with the notice period set in the contract (usually 1 to 3 months), notification by registered mail or any means provided in the mandate. Termination can itself be signed electronically and archived with the initial mandate.
- Is the electronically signed mandate opposable in court?
- Yes — French case law unanimously recognizes eIDAS-compliant electronic signatures. The reliability presumption of article 1367 of the Civil Code makes advanced signature (AES) opposable without further demonstration, provided the eIDAS audit trail is produced in court (proof PDF automatically delivered by Certyneo).
