Law of 1 July 1901 — art. 5

Any association must be declared to the prefecture of the department of its headquarters. Art. 5 requires declaration of statutory changes within 3 months. The e-creation online service accepts electronic signature.

Law No. 2014-856 — administrations/associations relations

Frequently asked questions from associations

Can association bylaws be signed electronically?

Yes, without restriction. The law of 1 July 1901 does not require handwritten signature of bylaws. Art. 1366 of the Civil Code recognizes electronic writing with the same probative value as paper writing. Certyneo advanced signature (AES) is accepted by prefectures via the e-creation online service on service-public.fr.

Does the prefecture accept a declaration signed electronically?

Yes — the e-creation online service (service-public.fr/associations) accepts upload of electronically signed documents. For associations preferring paper format, the signature can also be printed and sent by mail (prefectures continue to accept both formats).

Can an association GA be held remotely?

Yes — ordinance No. 2020-321 of 25 March 2020 (made permanent) allows association GAs to be held remotely or in hybrid format with voting by correspondence or videoconference. Electronic signature of minutes by the board (president, secretary) is allowed.

What signature level for bylaws?

How long must bylaws and minutes be retained?
