What is a property management mandate?
A property management mandate is a contract by which a landlord owner entrusts to a real estate professional (agency, property manager) the routine management of one or more rental properties: tenant search, rent collection, maintenance management, tax reporting, disputes. It is governed by Law No. 70-9 of January 2, 1970 (known as the "Hoguet Law") and subject to strict rules: professional G card (property management), financial guarantee, mandatory mentions, maximum term and termination conditions.
Why sign the mandate electronically?
Identical legal value
Article 1366 of the French Civil Code recognizes electronic writing with the same probative force as paper writing, provided the person from whom it originates can be identified and the document is preserved under conditions guaranteeing its integrity. No Hoguet decision requires handwritten signature.
Multi-signatories (couple, joint ownership)
When the property is jointly owned or in community of property, all co-owners must sign under penalty of partial nullity. Our flow handles sequential or parallel signature: each signatory receives a secure individual link protected by SMS OTP and signs at their own pace.
10-year archiving included
Article 72 of the July 20, 1972 decree requires the real estate agent to preserve mandates for 10 years. Certyneo automatically archives the signed mandate + its eIDAS audit trail for this entire period, accessible with one click from your dashboard.
Enforceable eIDAS audit trail
Each mandate comes with a proof PDF: identity of signatories, qualified timestamp, SHA-256 hash, IP geolocation, SMS OTP verification. Enforceable in case of dispute over the commission, duration or powers conferred.

Frequently asked questions
- Can a property management mandate be signed electronically?
- Yes, without restriction. The Hoguet Law does not require handwritten signature: only the mentions in Article 1 of the July 20, 1972 decree are mandatory (professional card, financial guarantee, duration, scope, commission). Article 1366 of the French Civil Code gives electronic signature the same value as paper signature as soon as the signatory''s identification and document integrity are guaranteed.
- Which signature level to choose: SES, AES or QES?
- For a property management mandate, advanced signature (AES) is the professional standard. It provides enhanced reliability presumption through identity verification (SMS OTP) and a unique certificate per signatory. QES is reserved for real estate sales by notarial deed (notary); SES (simple signature) is sufficient for minor amendments but undersized for the mandate itself.
- What to do in case of co-ownership or joint ownership?
- All co-owners must sign the mandate under penalty of partial nullity (art. 815-3 French Civil Code). Certyneo''s multi-signatory flow handles sequential signature (one after another) or parallel (all at the same time). Each signatory receives their personal link with SMS OTP on their own number — no credential sharing.
- How long must the mandate be kept?
- 10 years from the end of the mandate, in accordance with Article 72 of Decree No. 72-678 of July 20, 1972. Certyneo preserves the signed mandate and its eIDAS audit trail for this entire period, free of charge, with immediate access from your dashboard to respond to a CCI or DGCCRF inspection.
- What are the mandatory mentions of a management mandate?
- Complete identity of the parties, G professional card number of the agent, body and amount of financial guarantee, duration (maximum 30 years in management), powers limitatively enumerated, compensation methods (commission rate or amount), termination conditions and notice period, designation of competent jurisdiction.
- Is the property management mandate different from the sales mandate?
- Yes — the management mandate (G card) concerns routine management of a rental property (rents, maintenance, taxes). The sales mandate (T card) concerns finding a buyer. The legal obligations, commissions and maximum duration are distinct; a real estate agent must hold the correct professional card to exercise each activity.
- Can an electronically signed property management mandate be terminated?
- Yes — termination follows the same rules as for a paper mandate: respect of the notice period set in the contract (generally 1 to 3 months), notification by registered letter or any method provided for in the mandate. Termination itself can be electronically signed and archived with the initial mandate.
- Is the electronically signed mandate enforceable before courts?
- Yes — French case law unanimously recognizes eIDAS-compliant electronic signature. The reliability presumption in Article 1367 of the French Civil Code makes advanced signature (AES) enforceable without further demonstration, provided the eIDAS audit trail is produced in court (proof PDF automatically delivered by Certyneo).
