What are the advance directives?
Advance directives are the written expression by any adult of his or her wishes regarding treatment and care in case of inability to express his or her wishes (loss of consciousness, coma, end of life).Regulated by Article L1111-11 of the Public Health Code derived from the Claeys-Leonetti Law of 2 February 2016, they are binding on the doctor unless they are a life-emergency or if they appear manifestly inappropriate.Decree no. 2016-1067 of 3 August 2016 created an official CERFA model containing two forms: (1) if I am at the end of my life or if I have a serious condition, (2) if I am not at the end of my life.

Frequently Asked Questions
- Can advance directives be signed electronically?
- Yes, without restriction. Article L1111-11 CSP requires a written form but does not prescribe any particular form. The advanced signature (AES) Certyneo meets the requirements of proof and is even superior to paper (identity verified by OTP, impossibility of signature by a third party).
- Is the CERFA model compulsory?
- No Article L1111-11 also allows for free advance directives, provided they are written, dated and signed by the signatory (identifiable by name, surname, date and place of birth).
- Are advance directives revocable?
- Yes, at any time and by any means (Art. L1111-11 CSP).The revision can be made via Certyneo by signing a new set of directives which cancels and replaces the previous ones.The audit trail traces the exact date and the active version.
- How can we be sure the doctors will know about this?
- Several options: (1) upload your Shared Medical Record (SDR) to monespacesante.fr, (2) give it to your attending physician who will insert it into your medical record, (3) give it to your trusted person who can present it, (4) keep a copy on you (portfolio card with mention).
- What signature level for advance directives?
- It provides a presumption of reliability (Article 1367 of the Civil Code) and satisfies the requirements of proof in case of objection by the family or in case of doubt about the authenticity by the resuscitator.
- How long are advance directives valid?
- Certyneo archives 20 years automatically (duration of the medical record, Art. R1112-7 CSP).
- Can a person under guardianship sign advance directives?
- Yes Article L1111-11 CSP allows for advance directives from a guardian, with the authorization of the guardian judge or the family council (without recourse to the guardian).
- Are electronically signed advance directives enforceable against the doctor?
- Yes Article L1111-11 CSP requires the doctor to comply with it unless it is a vital emergency or if it appears obviously inappropriate (subject to the collegial procedure).
