Electronic signature for Commissioners of Justice

Electronic signature solution for court bailiffs' studies (profession born from the merger of bailiffs and bailiffs-receivers, exclusive status as of 1 July 2026) for the management of private-seing documents of the study : warrants for the friendly collection of debts, fee agreements, collective agreements with creditors, letters of mission, confidentiality commitments, agreements with partners. Complies with the Statute of the Commissioner of Justice (Ordinance No 2016-728 of 2 June 2016), Decree No 96-1112 on the friendly collection and the eIDAS Regulation recommended advanced signature, permanent value archiving. The meanings, meanings and monopoly of the professional record are preserved via the ministerial platform of the SEC (UCTRA).

Que peut signer un commissaire de justice avec Certyneo ?

Le commissaire de justice intervient dans deux registres distincts. Les ACTES MINISTÉRIELS relevant de son monopole (significations d'assignations, commandements, sommations, constats, procès-verbaux, ventes judiciaires) sont, lorsqu'ils sont dématérialisés, signifiés par voie électronique au sens des articles 748-1 et suivants du Code de procédure civile, via la plateforme sécurisée SECURACT de la Chambre nationale des commissaires de justice, avec signature électronique qualifiée et dispositif professionnel dédié — un périmètre non couvert par Certyneo. Les ACTES SOUS SEING PRIVÉ de l'étude (mandats de recouvrement amiable de créances régis par le décret n° 96-1112, conventions d'honoraires, contrats de recouvrement conclus avec les créanciers, lettres de mission, engagements de confidentialité, conventions avec les prestataires et partenaires) sont en revanche parfaitement couverts par la signature électronique avancée (AES). Certyneo dématérialise toute cette relation contractuelle de l'étude, avec un niveau de preuve compatible avec les exigences déontologiques de la profession et le secret professionnel.

The number of signatures is determined by the number of signatures in the register.

    Please upload your draft (collection order, fee agreement, collection contract, letter of assignment) and make sure that the mandatory information in Decree 96-1112 is included in the collection order (identity of the Commissioner of Justice and creditor, basis and amount of the claim, conditions for reimbursement).

    For a portfolio of claims or several co-creditor, add all the creditors: each receives a secure link with an individual SMS OTP.

    Advanced signature (AES) recommended for private study documents: identity verification by SMS OTP, single certificate, qualified time stamping.

  4. 4. Evidence-based archiving

    The completed document and its audit trail are archived as evidence and can be exported at any time for transmission to a successor colleague or production before the Regional Chamber of the Commissioners of Justice.

Can Certyneo be used for meaning and observations?
No the service and statements are the exclusive responsibility of the Commissioner of Justice. They are not digitised and are served electronically (Articles 748-1 et seq. of the Code of Civil Procedure) via the SECURACT secure platform of the National Chamber of Commissioners of Justice, with a qualified signature and a dedicated professional device.
Can the collective bargaining agreement be signed electronically?

Certyneo natively handles bulk mailing and serial or parallel signing. For a study that deals with large volumes of collection for lenders, trustees or e-commercials, each mandating creditor receives their personal link with SMS OTP. The audit trail collects all signatures and time stamps.
How long must the documents be kept in private?
The documents in private storage relating to the study activity must be kept for a minimum of 10 years (common law limitation period, Art. 2224 of the Civil Code).
Is the electronic private document open to challenge?
The presumption of reliability of Article 1367 of the Civil Code makes the advanced signature (AES) countervailable without further proof, including for recovery orders and agreements concluded by the study.
