Exercising a health profession exposes practitioners daily to considerable legal and financial risks. A simple diagnostic error, a poorly executed technical procedure or a failure to provide information can engage the professional's liability and lead to compensation payments reaching several million dollars. Professional liability insurance (RCP) thus constitutes the healthcare professional's first line of defence against the hazards of their activity.
A non-negotiable legal obligation
Since the Kouchner Act of 4 March 2002 relating to patients' rights and the quality of the health system, all health professionals exercising in private practice have been obliged to take out professional liability insurance. This requirement is codified in Article L.1142-2 of the Public Health Code.
Those affected include: general practitioners and specialists, dentists, midwives, nurses, physiotherapists, speech therapists, podiatrists, osteopaths, as well as private healthcare establishments. Failure to obtain insurance is penalised by a fine of 45,000 euros and a prohibition from practising.
Essential guarantees of the health RCP contract
A well-structured professional liability insurance contract for health professionals must cover several areas:
Operating liability covers damages caused in the course of daily activity: a patient falling in the waiting room, damage to property entrusted, incident related to premises.
Medical professional liability indemnifies harm resulting directly from care acts: diagnostic error, technical fault, failure to inform the patient, nosocomial infection in certain cases.
Legal protection covers defence costs in the event of proceedings before civil, criminal or professional regulatory courts, as well as before the Conciliation and Compensation Commission (CCI).
Minimum guarantee amounts are set by Decree No. 2011-2030 of 29 December 2011: 8 million euros per claim and 15 million euros per year of insurance for high-risk medical professions.
Factors influencing insurance premium costs
The cost of RCP varies considerably according to several parameters: the specialty exercised (an obstetric surgeon will pay significantly more than a general practitioner), turnover, seniority, past claims history, and the level of excess chosen. Obstetrician-gynaecologists and orthopaedic surgeons are among the most exposed, with annual premiums potentially exceeding 25,000 euros.
Claims declaration: best practices
In the event of a patient complaint, the professional must declare the claim to their insurer within five business days in accordance with Article L.113-2 of the Insurance Code. It is important never to directly admit liability to the patient and to quickly transmit the entire medical file, correspondence received and any factual element useful for analysis.
